This policy explains how Mocamoco Co., Ltd. ("we", "our") responds to requests for user data from government agencies, law enforcement authorities, and other parties seeking disclosure through legal process. It applies to the MocaMoco MOON app ("the App").
MocaMoco MOON is a menstrual cycle and health tracking app. We believe that records about your body and health are among the most sensitive information there is, and we review every request for user data with that in mind.
We respond only to legally valid and binding process — such as a warrant or a court order — issued by an authority with jurisdiction over us. Before acting on any request, we verify its authenticity, the identity and authority of the issuing body, and its legal basis.
We do not disclose user data in response to voluntary or informal requests (for example, requests made by email or phone without legal process), except in the emergency cases described in Section 5.
Mocamoco Co., Ltd. is a company incorporated in Japan, and user data for the App is stored in Japan. Requests are evaluated under Japanese law.
Legal process issued by authorities outside Japan (including the United States) generally does not, on its own, have binding force over us. We expect foreign authorities to use international legal assistance channels — such as the mutual legal assistance treaty (MLAT) between their country and Japan — so that a request reaches us as process valid under Japanese law.
Our policy is to notify the affected user before disclosing their data, so that the user has an opportunity to object or seek legal remedies, unless:
Where notice is delayed for these reasons, we will notify the user once the restriction no longer applies.
If we believe in good faith that there is an emergency involving imminent danger of death or serious physical injury to a person, we may disclose the minimum data necessary to prevent that harm. Every such disclosure is recorded and reviewed afterwards.
We can only produce data that we actually hold. In outline, the App stores:
We do not collect precise location data. Data retention is described in our Privacy Policy; we cannot produce data that we no longer hold.
Requests should be submitted in writing to moon@mocamoco.com and should include:
Submitting a request does not obligate us to disclose data. We may seek clarification, narrow the scope, or reject requests that do not meet the requirements of this policy.
We may update this policy from time to time. The revised policy takes effect when posted. Material changes will be announced through in-app notices or similar means.
